Terms and Conditions

„Finca Paraíso Monturrio“
Landlady: Janet Wachter Steckmann, Calle Familia Iriarte 9, 38300 La Orotava

1. Arrival / Departure

Arrival and departure times also apply to individually agreed weekdays. Departure must take place by 11.00 am at the latest on the day of departure.
If the departure time is exceeded by more than 30 minutes, an additional night’s accommodation will be charged. These are generally possible.

2. Special requests and additional agreements

These require written confirmation from the landlord. For pets, the type and size must be specified.

3. Payment

The tenancy agreement becomes valid upon receipt of the deposit into the landlord’s account. The deposit, amounting to 50 per cent of the rental sum, is due for payment within seven days of receipt of the booking documents. Once the deposit has been paid, the balance is due 30 days before the start of the holiday. If the payment deadlines are not met, the landlord may withdraw from the contract. Non-payment shall be deemed a withdrawal and entitles the landlord to re-let the property.
There are no additional charges for water, car parking or waste disposal.

4. Cancellation

You may cancel the contract at any time.
Cancellation must be made in writing. In the event of cancellation, you are obliged to compensate us for any loss we have incurred:

  • from the date of the booking confirmation by the landlord up to the 121st day before the start of the tenancy: no compensation
  • from the 120th day up to the 61st day before the start of the tenancy: the amount of the deposit
  • from the 60th day up to the 15th day before the start of the rental period: 60 per cent of the total price
  • from the 14th day up to the 8th day before the start of the rental period: 80 per cent of the total price
  • If you withdraw less than eight days before the start of the rental period, the full holiday price is payable.

The date on which we receive your notice of cancellation shall apply. Any amounts already paid will be offset.
You may appoint a replacement who will take over your contract under the terms specified. Written notification is sufficient.

5. Obligations of the tenant

The tenant undertakes to treat the rented property (holiday home, contents and outdoor facilities) with due care. If damage occurs to the holiday home and/or its contents during the tenancy, the tenant is obliged to report this to the property management company without delay.

Any defects or damage identified on arrival must be reported to the property management company immediately; otherwise, the tenant shall be liable for such damage. A reasonable period of time must be allowed for the repair of damage and defects.
Claims arising from complaints that are not reported immediately on site are excluded. Complaints received by the landlord only at the end of the stay or after the tenant has left the holiday home are also excluded from compensation.
In the event of any disruption to services, the tenant is obliged to do everything reasonably expected of them within the scope of their legal obligations to help resolve the disruption and minimise any damage incurred.
On the day of departure, the tenant must remove their personal belongings, dispose of household waste in the designated bins, and store crockery, clean and washed, in the kitchen cupboards.

6. Data Protection

The tenant agrees that personal data necessary within the scope of the contract concluded with them may be stored, amended and/or deleted. All personal data will be treated with the utmost confidentiality.

7. Liability

This property listing has been drawn up to the best of our knowledge. No liability is accepted for any impact on the rental property caused by force majeure, power cuts and water cuts customary in the region, or severe weather conditions. Likewise, no liability is accepted in the event of unforeseeable or unavoidable circumstances, such as official orders, sudden construction work or disruptions caused by natural or local conditions. However, the landlord will be happy to assist in resolving any problems (where possible).
The landlord accepts no liability for the use of the games and sports equipment provided.
The tenant is responsible for their own arrival and departure. The landlord accepts no liability for personal belongings in the event of theft or fire. The tenant is fully liable for any wilful damage or destruction.

8. Final Provisions

Photographs and text on the website or in the leaflet are intended to provide a realistic description. We cannot guarantee that they will correspond 100 per cent to the rental property. The landlord reserves the right to make changes to the fittings (e.g. furniture), provided they are of equivalent value.
Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that most closely reflects the economic and legal intent of the contracting parties.
Spanish law shall apply. The place of jurisdiction and place of performance shall be the landlord’s place of residence.
